Welcome to Tropical Fantasy (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of the website located at tropicalfantasy.com, including any content, functionality, and services offered on or through the site (collectively, the “Site”). 

By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site. 

  1. Eligibility 

You must be at least 13 years old (or 16, where a higher age applies under applicable law) to use this Site. If you are under the age of majority in your jurisdiction, you may use the Site only with the involvement of a parent or legal guardian. By using the Site, you represent and warrant that you meet this requirement. 

  1. Account Registration 

The Site does not currently require or offer account registration. If we add account features in the future, we will update these Terms accordingly.

You agree to use the Site only for lawful purposes. You agree not to: 

Violate any applicable local, state, national, or international law. Infringe upon the intellectual property rights of the Company or any third party. Use any automated system (bots, scrapers, etc.) to access the Site without our prior written permission. Harass, abuse, or harm another person through use of the Site. We reserve the right to restrict or terminate your access to the Site for violating these Terms. 

  1. Products and Services 

Where our products are available for purchase, those sales are made through third-party retailers and distributors subject to their own terms and policies, not through this Site. 

Any pricing information displayed on the Site is for general reference only, is listed in USD, and is subject to change without notice. Actual prices are set by the retailers and distributors who sell our products. 

  1. Payments. The Site does not process payments or accept orders. We do not collect payment information through the Site. 
  1. Cancellations and Refunds 

Because the Site does not sell products or accept orders directly, we do not process cancellations or refunds through the Site. Any returns, refunds, or cancellations are handled by the third-party retailer from whom you purchased our products, subject to that retailer’s policies. 

  1. Intellectual Property 

All content on the Site — including text, graphics, logos, images, audio, video, and software — is the property of Tropical Fantasy or its licensors and is protected by copyright, trademark, and other intellectual property laws. 

You may not reproduce, distribute, modify, publicly display, or create derivative works from any content on the Site without our prior written consent. 

  1. User-Generated Content 

The Site does not currently allow users to post reviews, comments, or other user-generated content. If we add such features in the future, we will update these Terms accordingly.

The Site may contain links to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy policies, or practices of any third-party sites. Your interactions with third parties are solely between you and them.

We do not warrant that the Site will be uninterrupted, error-free, or secure, or that any defects will be corrected.

TO THE FULLEST EXTENT PERMITTED BY LAW, TROPICAL FANTASY AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. 

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SITE SHALL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, PRECEDING THE CLAIM.

You agree to indemnify, defend, and hold harmless Tropical Fantasy and its affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site or violation of these Terms.

We reserve the right to suspend or terminate your access to the Site at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties. 

  1. Governing Law and Dispute Resolution 

These Terms shall be governed by and construed in accordance with the laws of New York without regard to its conflict of law provisions. 

Any dispute arising out of or relating to these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in Ulster County, New York, and each party consents to the personal jurisdiction of such courts and waives any objection to venue there.

We may update these Terms from time to time. The “Last Updated” date at the top of this page will reflect the most recent changes. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms. 

  1. Severability 

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect. 

  1. Entire Agreement 

These Terms, together with our Privacy Policy and any other legal notices published on the Site, constitute the entire agreement between you and Tropical Fantasy regarding your use of the Site.
